2. Geltungsbereich

Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Bestellungen, die über den Online-Shop thenaildoll.com getätigt werden.

Abweichende Bedingungen der Kundin/des Kunden werden nicht anerkannt, es sei denn, The Nail Doll stimmt ihrer Geltung ausdrücklich schriftlich zu.

3. Angebot und Produktbeschreibung

Alle angebotenen Produkte sind handgefertigte Press-on-Nails.

Jedes Set wird nach Bestellung individuell angefertigt und kann daher geringfügig von den Produktfotos abweichen (z. B. durch Farbton, Glanz oder Designvariationen).

Solche Abweichungen sind kein Reklamationsgrund, sondern Ausdruck der handwerklichen Fertigung.

4. Bestellvorgang und Vertragsabschluss

1. Die Darstellung der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot dar, sondern eine Einladung zur Bestellung.
2. Durch das Absenden einer Bestellung gibst du einen rechtlich verbindlichen Vertrag für diese Bestellung ab.
3. Der Vertrag kommt außerdem zustande, sobald du die Bestätigungsemail erhältst.

5. Preise und Zahlungsbedingungen

Alle angegebenen Preise sind Endpreise und enthalten gemäß §19 UStG keine Umsatzsteuer (Kleinunternehmerregelung).

Die Versandkosten werden im Bestellvorgang angezeigt.

Zahlungsmöglichkeiten:

• PayPal
• Kreditkarte (über Zahlungsanbieter)
• Vorkasse
• Apple Pay

Die Zahlung ist sofort nach Bestelleingang fällig.

6. Lieferzeit und Versand

Da alle Produkte handgefertigt werden, beträgt die Produktions- und Lieferzeit in der Regel 5–14 Werktage, abhängig vom Auftragsvolumen.

Der Versand erfolgt per Post/DHL an die vom Kunden angegebene Lieferadresse.

The Nail Doll übernimmt keine Haftung für Lieferverzögerungen, die durch Versanddienstleister oder fehlerhafte Adressangaben entstehen.

7. Kein Widerrufsrecht / Rückgabeausschluss

Da alle Produkte bei The Nail Doll individuell und in Handarbeit angefertigt werden, besteht kein Widerrufsrecht gemäß §312g Abs. 2 Nr. 1 BGB.

Ein Rückgabe- oder Umtauschrecht ist ausgeschlossen, außer:

• Die Ware wurde beschädigt geliefert, oder
• Es liegt ein nachweislicher Herstellungsfehler vor.

In diesen Fällen kontaktiere uns bitte innerhalb von 7 Tagen nach Erhalt der Ware unter:

8. Eigentumsvorbehalt

Die Ware bleibt bis zur vollständigen Bezahlung Eigentum von The Nail Doll.

9. Haftungsausschluss

Für Schäden, die durch unsachgemäße Anwendung, Entfernung oder Lagerung der Press-on-Nails entstehen, übernimmt The Nail Doll keine Haftung.

Pflege- und Anwendungshinweise sind zu beachten; sie werden mit der Bestellung oder auf der Website bereitgestellt.

10. Urheberrecht

Alle Designs, Fotos, Texte und Inhalte auf thenaildoll.com sind urheberrechtlich geschützt.

Eine Verwendung, Vervielfältigung oder Nachahmung ohne ausdrückliche Zustimmung ist nicht gestattet.

11. Datenschutz

Personenbezogene Daten werden ausschließlich im Rahmen der geltenden Datenschutzgesetze erhoben, verarbeitet und genutzt.

12. Schlussbestimmungen

Sollten einzelne Bestimmungen dieser AGB unwirksam sein, bleibt die Gültigkeit der übrigen Bestimmungen unberührt.

Gerichtsstand ist – soweit gesetzlich zulässig – der Sitz von The Nail Doll.

These Terms & Conditions apply to all orders placed through the online shop thenaildoll.com.

By placing an order, the customer agrees to these Terms & Conditions as binding.

3. Products and Descriptions

All products sold by The Nail Doll are handmade press-on nails.

Each set is individually crafted after an order is placed.

Because all items are made by hand, slight variations in color, shape, or design may occur compared to the product photos.

Such differences are part of the handmade nature and do not constitute a defect.

4. Order Process & Contract Conclusion

1. The product listings on the website do not represent a legally binding offer, but an invitation to place an order.
2. By submitting an order, you make a binding offer to purchase the product(s).
3. The contract becomes effective once The Nail Doll confirms the order via email or dispatches the goods.

5. Prices & Payment

All prices listed are final prices under the small business regulation (§19 UStG – no VAT charged).

Shipping costs are displayed before the order is completed.

Accepted payment methods:

• PayPal
• Credit card (via payment provider)
• Bank transfer (prepayment)
• Apple Pay

Payment must be made immediately after placing the order.

6. Production Time & Shipping

Since each product is handcrafted, production and shipping usually take 5–14 business days, depending on order volume.

Delivery is made via postal service or courier to the address provided by the customer.

The Nail Doll is not liable for delivery delays caused by shipping providers or incorrect delivery addresses.

7. No Right of Withdrawal / Return Policy

All products from The Nail Doll are handmade and custom-made to order.

Therefore, in accordance with §312g (2) No. 1 of the German Civil Code (BGB), no right of withdrawal or return applies.

Returns or exchanges are only accepted in the following cases:

• The product arrives damaged, or
• A manufacturing defect is clearly proven.

8. Retention of Ownership

All goods remain the property of The Nail Doll until full payment has been received.

9. Liability Disclaimer

Please follow the provided application and care instructions carefully to achieve the best results.

All designs, photos, texts, and content published on thenaildoll.com are protected by copyright.

Any duplication, imitation, or commercial use without prior written consent is strictly prohibited.

11. Privacy Policy

Personal data is collected and processed only in accordance with applicable data protection laws (GDPR).

12. Final Provisions

If any clause of these Terms & Conditions is found invalid, the remaining provisions remain in full effect.

German law shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

The place of jurisdiction, where legally permissible, is the business location of The Nail Doll.
